DBR

Who we are

  • Dad Bod Rebuild (ABN 41 762 511 399) (“DBR”, “we”, “us”, “our”) provides online health and fitness coaching services to clients in Australia
  • We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”). This policy explains how we handle personal information collected through our website, our coaching services and the platforms we use.
  • This document also serves as a collection notice explaining the kinds of personal information we collect, the purposes for which we collect it, how we use and disclose it, and how you may contact us about your information.
  • Where we ask you to provide sensitive information, including health information, we will seek your consent where required by the Privacy Act. You are not required to provide information that is not reasonably necessary for the relevant purpose; however, if you do not provide information that we reasonably require to provide coaching safely and effectively, we may be unable to provide some or all of our services to you.
  • Nothing in this policy limits any rights you may have under the Privacy Act, the APPs or other applicable laws.
  • We do not rely on your use of our website or engagement of our services alone as consent to collect sensitive information

What we collect

Information you give us directly. This includes:

  • Identity and contact details — name, email address, phone number, date of birth and postal address where relevant.
  • Enquiry information — the details you provide when booking a discovery call or contacting us.
  • Onboarding information — your goals, training history, lifestyle, schedule, exercise preferences and other information relevant to designing your coaching program.
  • Health information — your pre-exercise screening (PAR-Q) answers, injuries, medical conditions, medications, physical limitations, health history and any other health matters you voluntarily disclose to your coach.
  • Progress information — body measurements, weight, InBody scan results, training logs, nutrition tracking, exercise performance and progress photos.
  • Communication information — messages, emails, check-in responses, feedback and other information you provide to us in the course of receiving coaching.

Information collected automatically. When you visit our website we may collect your IP address, browser and device type, pages viewed, referring website, approximate location and information about how you interact with our website, using cookies and similar technologies.

Sensitive Information. Health information is “sensitive information” under the Privacy Act. We will only collect sensitive information where permitted by the Privacy Act and, where required, with your consent.

We will generally collect personal information directly from you. Where we collect personal information about you from another person or organisation, we will do so only where permitted by law or with your consent, where appropriate.

You should only provide us with personal information about another person where you are authorised to do so or where otherwise permitted by law.

Why we collect it

  • We use your personal information to:
    provide coaching, design your training and nutrition program, and adjust it over time;
  • screen for health risks before you begin training and monitor your safety throughout;
  • communicate with you, respond to enquiries and provide support;
  • process payments, manage subscriptions and keep financial records;
  • track and report your progress;
  • improve our services, website and client resources;
  • send you marketing communications in accordance with applicable privacy and spam laws and where you have consented or we are otherwise permitted to do so; and
  • meet our legal, tax and record-keeping obligations.

We will not use your personal information for a purpose unrelated to the above without first obtaining your consent, unless the use is otherwise permitted or required by law.

Where reasonably practicable, we will collect only the personal information that is reasonably necessary for the relevant purpose.

We may use de-identified or aggregated information for analytical, statistical, business improvement and research purposes, provided that the information cannot reasonably be used to identify you.

Progress photos and testimonials

Progress photos are used for coaching purposes only. We will never publish, share or use your photos, results, quotes or first name in any marketing without your separate written consent.

That consent is given through our Photo & Testimonial Release, is entirely optional, and is not a condition of receiving coaching.

You may withdraw your consent at any time by contacting us. We will stop using the material in future marketing, though we may be unable to recall material already published or distributed.

Where you provide a testimonial, review, photograph or other content for publication, we will only use that material for the purposes and in the manner authorised by your separate consent.

Refusing to provide, or subsequently withdrawing, consent for marketing use of your photos or testimonials will not affect your eligibility to receive our coaching services.

Who we share it with

We do not sell, rent or trade your personal information.

We share information only with service providers who help us run the business, and only to the extent reasonably necessary. These may include:

  • Everfit — our coaching platform, which hosts your program, check-ins, messages and progress data.
  • Stripe — our payment provider, which processes your payments and stores your card details securely.
  • Email, scheduling and form providers — used to send communications, take bookings and collect onboarding and consent forms.
  • InBody scan providers — where you attend a scan arranged or recommended by us.
  • Professional advisers — such as our accountant, lawyer or other professional advisers, where reasonably required.

We may also disclose personal information to contractors, technology providers, insurers, auditors or other service providers where reasonably necessary to operate our business or provide our services, subject to applicable privacy obligations.

We may also disclose personal information where required or authorised by law, or where necessary to prevent or lessen a serious threat to a person’s life, health or safety.

Where we use third-party service providers, we take reasonable steps to ensure that they handle personal information appropriately and consistently with applicable privacy obligations.

Overseas disclosure

Some of our service providers store or process data outside Australia, including in the United States and the European Union.

The location in which information is stored or processed may change from time to time as our service providers update their infrastructure and systems.

Where required by the Privacy Act, we will take reasonable steps before disclosing personal information overseas to ensure that the overseas recipient does not breach the APPs in relation to that information.

Where the Privacy Act requires us to obtain your consent to an overseas disclosure, we will obtain that consent before making the relevant disclosure.

By providing your personal information, you acknowledge that some of our service providers may process or store information overseas. This acknowledgement does not replace any consent that is expressly required by the Privacy Act.

Security and storage

We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. This includes password-protected accounts, reputable platforms, and limiting access to information on a need-to-know basis.

No method of transmission or storage is completely secure. While we take our obligations seriously, we cannot guarantee absolute security of information transmitted over the internet.

We keep your personal information only as long as we need it for the purposes described in this policy, or as required by law. Financial records are generally kept for seven years. When information is no longer needed, we take reasonable steps to destroy or de-identify it.

Where we become aware of a data breach involving personal information, we will assess and respond to the incident in accordance with our legal obligations, including the Notifiable Data Breaches scheme where applicable.

If a data breach is likely to result in serious harm and notification is required by law, we will take the steps required by the Privacy Act to notify affected individuals and/or the Office of the Australian Information Commissioner.

Cookies and website analytics

Our website uses cookies to make the site work properly, remember your preferences and understand how visitors use it.

We may use analytics and similar technologies to understand website traffic, identify technical issues and improve our website and services.

Where third-party analytics or advertising technologies are used, those providers may collect information directly through cookies or similar technologies in accordance with their own privacy policies.

You can disable cookies in your browser settings, though some parts of the website may not function correctly if you do.

Marketing communications

We only send marketing emails and other electronic marketing communications where you have opted in or where we are otherwise permitted to do so under applicable law.

We will comply with applicable requirements under the Spam Act 2003 (Cth), including providing an appropriate unsubscribe mechanism for commercial electronic messages where required.

Every marketing email includes an unsubscribe link, and we will action unsubscribe requests promptly.

Unsubscribing from marketing does not stop essential service communications about your coaching, payments or account.

You may also contact us directly to withdraw your consent to receive marketing communications.

Accessing and correcting your information

You may request access to the personal information we hold about you, and ask us to correct anything inaccurate or out of date. Contact us using the details in section 12.

We will respond within a reasonable period, and generally within 30 days where practicable.

We do not charge for making a request, though a reasonable fee may apply for providing access in some circumstances where permitted by law. We will not charge you for making a correction request.

If we refuse access or refuse to correct personal information, we will provide written reasons for our decision where required by law and explain any available complaint or review options.

You may ask us to delete your personal information. We will do so where reasonably possible and where we are not required or authorised by law to retain it.

We may need to retain certain information for legal, tax, accounting, insurance, dispute resolution, fraud prevention or other legitimate business purposes. Where information cannot be deleted, we will continue to handle it in accordance with our privacy obligations.

Complaints

If you believe we have breached the APPs or otherwise mishandled your personal information, please contact us first using the details below. We will investigate and respond in writing, and aim to resolve your complaint as soon as reasonably practicable.

If you are not satisfied with our response, or if your complaint is not resolved, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992..

Changes to this policy

We may update this policy from time to time. The current version is always available on our website, and the effective date appears on the cover.

Material changes will be notified to active clients by email where reasonably appropriate.

The date on which this policy was last updated will be identified at the beginning or end of the policy.

Your consent to the collection of sensitive information

You consent to DBR collecting and using your health information for the purposes of assessing your suitability for exercise, providing coaching, developing and modifying your training and nutrition programs, monitoring your progress and providing coaching support.

You understand that providing health information is voluntary unless otherwise required by law or reasonably necessary to provide the relevant service, but that failure to provide information reasonably required for safe and effective coaching may mean that DBR cannot provide some or all coaching services to you.

Your consent to the collection and use of health information does not constitute consent to the use of your photographs, testimonials or other content for marketing. Any such use requires separate consent under section 4 and the applicable Photo & Testimonial Release.

You may withdraw your consent to the collection or use of your sensitive information by contacting DBR. You understand that withdrawal of consent may affect DBR’s ability to continue providing some or all coaching services where the relevant information is reasonably necessary for those services
